Terms of Service

1. Acceptance of terms

By creating an account or using the Last Bite platform in any way, you agree to these Terms of Service. If you do not agree, do not use the platform.

These terms apply to all users of the platform, including consumers and business partners. Additional terms may apply to business partners and are provided during the onboarding process.

2. The service

Last Bite is a digital marketplace that enables food businesses to list surplus food for sale and consumers to purchase and collect that food. Last Bite acts as an intermediary. The sale of food is a transaction between the business and the consumer. Last Bite is not a party to that sale.

We reserve the right to modify, suspend, or discontinue the platform or any part of it at any time, with reasonable notice where possible.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You must be at least 18 years old to create an account. By creating an account, you confirm that you meet this requirement.

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or are used in a manner that harms the platform or other users.

4. Orders and payments

When you place an order through Last Bite, you are entering into a purchase agreement with the business. Payment is due at the time of reservation. Orders are confirmed upon successful payment.

You agree to collect your order within the designated pickup window. Orders not collected within the pickup window are forfeited without refund, except where the business cancels or fails to fulfil the order.

If a business cancels an order, you will receive a full refund within 3-5 business days. Refunds for quality issues are handled on a case-by-case basis.

5. Food safety

All businesses on the platform are required to hold valid food handling certifications for their jurisdiction and to comply with applicable food safety regulations. Last Bite verifies certifications during onboarding but does not inspect individual listings or food preparation.

Consumers are responsible for reviewing allergen and dietary information provided in listings before purchasing. If you have a severe food allergy, contact the business directly before purchasing.

6. Business partners

Businesses that list food on the platform agree to:

• Provide accurate descriptions of the food category and allergen information
• Fulfil orders that have been paid for and confirmed
• Maintain food safety and hygiene standards required by applicable law
• Set pickup windows that reflect actual operating hours
• Not list food that is unsafe, expired, or misrepresented

7. Prohibited use

You may not use the platform to:

• Create false or misleading listings
• Engage in fraud or deceptive practices
• Harass, threaten, or harm other users or business staff
• Attempt to access systems or data without authorisation
• Resell food purchased through the platform at a profit
• Use automated systems to bulk-purchase listings without permission

8. Intellectual property

The Last Bite name, logo, website, and platform are owned by Last Bite. You may not use our trademarks, copy our platform, or reproduce our content without written permission.

Content you submit to the platform, including reviews and business listings, remains your property. By submitting content, you grant Last Bite a licence to display and use that content in connection with operating the platform.

9. Limitation of liability

Last Bite acts as a marketplace and is not responsible for the quality, safety, or legality of food sold by businesses on the platform. Our liability to you for any claim arising from your use of the platform is limited to the amount you paid for the relevant order.

We are not liable for indirect, incidental, or consequential damages arising from your use of the platform.

10. Governing law

These terms are governed by the laws of Trinidad and Tobago. Disputes arising under these terms are subject to the jurisdiction of the courts of Trinidad and Tobago.

11. Changes to these terms

We may update these terms. We will notify you of material changes by email or through a notice on the platform. Continued use of the platform after notice of changes constitutes acceptance of the updated terms.
